Employee invention

Employee invention

It is an invention made by a person who, without being under an obligation by reason of his employment, makes an invention, the exploitation of which falls within the field of business of his employer. The right to a patent for an employee invention belongs to the inventor, but the employer has a non-exclusive, non-transferable right of exploitation. (Act XXXIII of 1995, Articles 9 and 10)
