Publication

It is the making available to the public of the patent application after the expiry of 18 months from the earliest date of priority, except if the application constitutes a State secret. At the request of the applicant, the application may be published at an earlier date if it satisfies the requirements prescribed for publication. Deferment or omission of publication is not possible. When giving information on the publication in the official journal, the Hungarian Patent Office publishes the abstract describing the gist of the solution and the figure characterising the invention. Following that, any person may inspect the public documents of the application and may request copies upon payment of a fee. Publication gives rise to the so-called provisional patent protection.
